Concession for the Chácara Jockey Park

The City of São Paulo has just started an international public procurement to grant a long-term concession for the operation and maintenance of the Chácara Jockey Park. The future concessionaire will also have to carry out civil works and engineering services to improve the Park’s facilities and equipment.

The Federal Government has started 2018 with an ambitious promise: to implement over 70 infrastructure projects across the country.
In 2016, the Federal Government launched the Program of Investment Partnership (the “PPI”) to foster the implementation of infrastructure and privatization projects. The PPI is conducted by a Secretariat and Council linked to the Presidency of the Republic, which are responsible for qualifying projects for the program and monitoring their progress.

The Minister of Transport, Ports and Civil Aviation has just announced a proposal to include in the Federal Government Program of Investment Partnerships (PPI) three additional groups of airport concessions. The Minister announced the upcoming concessions in a public hearing carried out at the Brazilian Federal Senate. The estimated investments are around US$ 2.13 billion. The concessions are to be confirmed during a PPI conference in late August. The public procurement proceedings are expected to the begin in the first half of 2018.

Provisional Measure no. 752/16 was passed into Federal Law no. 13,448/2017, after its enactment on June 6th. The law sets the general guidelines for the extension and the re-publishing of contracts and new request for proposals, respectively, regarding partnership contracts in the roadway, railway, and airport sectors, previously qualified for such in the Program of Investment Partnership (PPI).
The Municipality of São Paulo Publishes a Request for Studies to Privatize Public Parks

The Secretariat for Privatization and Partnerships of the Municipality of São Paulo has recently published a Request for Studies (PMI) to privatize 14 municipal parks. In PMI proceedings, the Government relies on the expertise of the private sector to conduct studies regarding various aspects of projects such as legal, economic-financial, technical and environmental. The author is reimbursed for the costs incurred in the studies as established in the PMI, if the local Government uses them in the future public procurement proceeding.

The Law had been in the works since 1998, when Constitutional Amendment No. 19 changed Article 173 of the Constitution, which thereafter read as “the law will set forth the legal statute of government-controlled companies.” The Law is already in force and it has been recently regulated by Federal Decree No. 8,945, of December 27, 2016, which provides for further details on the provisions of the Law, especially in regards to minority equity participations and appointment of the Officers and members of the Fiscal Board.

Just a few hours after becoming the interim President of Brazil, Michel Temer created a new program for infrastructure projects – the Program of Investment Partnerships (PPI) through Provisional Measure No. 727/2016 (MP 727). Provisional Measures are normative acts from the President with legal status used in relevant and urgent cases. Provisional Measures must be submitted to the Congress, which will decide in up to a 60-day term whether such act should be passed into a law or not.

Governor Geraldo Alckmin has just announced an ambitious plan for concessions aiming at strengthening mobility in the State of São Paulo. The investment is estimated at approximately US$ 3.6 billion: US$ 2.8 billion in highways, US$ 25 million in regional airports, US$ 700 million in inter-municipal bus lanes and US$ 55 million in the subway system of the City of São Paulo. São Paulo is most industrialized State of Brazil and concentrates 43% of the foreign investment in the Country, according to the State’s statistics.

The Brazilian Government has just started the public procurement proceedings to grant long-term lease contracts for the operation of port terminals. The Government scheduled the first auction for December 9, 2015, at the floor of the São Paulo Stock Exchange (BM&F BOVESPA). The auctions are an important step aiming at the implementation of the Logistics Investment Program (PIL) announced in June. The PIL forecasts new lease contracts for 113 areas located inside Brazilian public ports.

The Special Secretariat for Ports (SEP) has recently announced a new model for the operation of dredging services in the access channels of Brazilian Ports. The revamped model will enable the Government to enter into medium or long-term concession contracts for the entire service operation, which should include not only the dredging of the access channels but also the maintenance services.
Our ports have been facing various difficulties with channels that silted up, which limit the access of vessels with deep draft. The Government was used to carry out bidding processes to retain only the dredging services through short-term service contracts.
